Law backs protection of race data says Australian racing

The Australian Racing Board (ARB) has released a legal opinion on Race Fields Legislation, as a reaction to the recent national court ruling on protection of databases.

ARB's main conclusion is that the effort alone of making a race database is no longer sufficient to obtain legal protection. The court ruling will make it necessary to prove that skill, judgment and knowledge has been applied in selecting the data for inclusion in the race database, as well as the compilation, presentation and arrangement of the data.

ARB believes that race databases fulfill the new criteria outlined by the court.
